STUDIO & Equipment HIRE TERMS AND CONDITIONS
These Terms and Conditions ("Terms") govern the hire of studio space and equipment from Cool Studio (ABN 55 181 895 038) of 127b Campbell Street, Collingwood VIC 3066 ("Cool Studio", "we", "our", "us").
By confirming a booking, making payment, or entering the premises, the person or business making the booking ("Customer", "you", "your") agrees to be bound by these Terms.
1. Bookings
Bookings are subject to availability and are confirmed only once payment, or other agreed payment confirmation, has been received.
Quotes are valid for 30 days unless otherwise stated and may be amended prior to booking confirmation.
Bookings are accepted on a first-come, first-served basis.
Any requests for set construction, custom installations, or cyclorama painting must be submitted in writing at least three (3) business days before the booking.
Cool Studio reserves the right to refuse or cancel any booking where the intended use is considered unsafe, unlawful, or inconsistent with these Terms.
2. Hire Period
The hire period begins and ends at the times specified in your booking confirmation.
The Customer must vacate the premises and return all hired equipment by the agreed finish time.
Early departure does not entitle the Customer to a refund.
Extensions are subject to availability and cannot be guaranteed.
3. Payment
Unless otherwise agreed in writing:
-
Full payment is required before the booking commences.
-
All prices are inclusive of GST where applicable.
-
Additional charges incurred during the booking are payable within 24 hours of invoice.
Cool Studio proudly offers a 50% First Nations discount to Customers identifying as Aboriginal and/or Torres Strait Islander.
4. Cancellation & Rescheduling
Bookings cancelled:
-
More than 48 hours before commencement: Full refund.
-
Less than 48 hours before commencement: 50% of the booking fee will be refunded.
Cool Studio reserves the right to consider exceptional circumstances at its sole discretion.
5. Permitted Use
The Studio is intended for photography, videography and other approved creative activities.
The Customer must notify Cool Studio in writing if the Studio will be used for any purpose outside its normal intended use.
The Customer agrees to:
-
behave respectfully towards neighbouring businesses and residents;
-
comply with all directions from Cool Studio staff;
-
comply with all applicable laws and workplace health and safety requirements;
-
ensure all guests also comply with these Terms.
Vehicles may temporarily use the driveway only while loading and unloading and if approved by staff.
6. Studio Access & Conduct
The Customer is responsible for the conduct of every person attending under their booking.
The Customer must ensure:
-
the maximum occupancy is not exceeded;
-
children under 16 remain supervised at all times;
-
no illegal activity occurs;
-
smoking, vaping and illegal drugs are prohibited inside the premises;
-
alcohol may only be consumed with prior approval;
-
animals are not permitted unless approved in writing.
Access codes and keys (if provided) are confidential and must not be shared.
Cool Studio reserves the right to end a booking immediately where behaviour is unsafe, abusive or unlawful without refund.
7. Studio & Equipment Use
The Customer must:
-
inspect all equipment upon collection;
-
immediately report any existing damage or faults;
-
use all equipment only for its intended purpose;
-
follow any instructions provided by Cool Studio or the equipment manufacturer;
-
not modify, dismantle or repair any equipment;
-
not sub-hire, lend or transfer equipment to another person.
Equipment hired for studio use must remain on the premises unless prior written approval has been given.
Only approved persons may operate specialised equipment.
8. Customer Responsibilities
During the hire period, the Customer is responsible for the Studio, equipment, furniture, props and accessories until they have been returned and inspected by Cool Studio.
The Customer agrees to exercise reasonable care at all times.
The Customer assumes full responsibility for the security of the Studio and all hired equipment during the hire period. Any loss, theft or damage arising from the Customer's failure to properly secure the premises, including leaving doors, roller doors, windows or other access points open or unlocked, will be the Customer's responsibility.
The Customer must immediately notify Cool Studio of:
-
any damage to the Studio or Equipment;
-
any equipment malfunction or defect;
-
any accident, injury or medical emergency occurring on the premises;
-
any loss, theft or attempted theft;
-
any break-in, security incident or suspected unauthorised access; and
-
any other incident that may affect the safety or security of the premises.
9. Cyclorama (Cyc)
Unless a fresh paint service has been purchased, the cyclorama is hired in its existing condition.
Current repaint fees are:
-
Small Studio — $80 + GST
-
Big Studio — $160 + GST
-
Whole Studio — $240 + GST
The Customer must not:
-
paint the cyclorama;
-
apply adhesives;
-
drill or screw into surfaces;
-
attach coverings;
-
walk on the curved section of the cyclorama.
If excessive marks or damage occur, repainting or repair costs will be charged.
10. Cleaning & Pack Down
The Customer must return the Studio in the same condition it was received, excluding fair wear and tear.
Before leaving, the Customer must:
-
return all furniture and equipment to its original location;
-
wash dishes used;
-
remove excessive rubbish;
-
leave makeup areas clean;
-
remove all personal belongings.
Where additional cleaning is required beyond normal use, Cool Studio reserves the right to charge a reasonable cleaning fee.
11. Damage, Loss & Repairs
The Customer is liable for any loss, theft or damage occurring during the hire period, excluding fair wear and tear.
This includes damage to:
-
Studio premises
-
cyclorama
-
furniture
-
props
-
lighting
-
cameras
-
accessories
-
hired equipment
Repair or replacement costs will be charged at current market value.
Customers must not attempt repairs themselves.
12. Equipment Failure
Cool Studio takes reasonable care to maintain all equipment.
However, equipment may occasionally malfunction without warning.
Where equipment failure occurs, Cool Studio's liability is limited to refunding the applicable hire fee for the affected equipment.
Cool Studio is not liable for any consequential losses including cancelled productions, loss of income, talent costs or rescheduling expenses.
13. Overtime
Overtime is charged at:
-
Small Studio — $90 + GST per hour
-
Big Studio — $170 + GST per hour
-
Whole Studio — $220 + GST per hour
The Customer should notify Cool Studio as soon as an extension is required.
Overtime remains subject to studio availability.
14. Return of Equipment
All hired equipment must be returned:
-
on time;
-
clean;
-
complete;
-
in the same condition supplied (excluding fair wear and tear).
Late returns may incur additional hire charges at the applicable hire rate until returned.
15. Personal Property
All personal belongings, cameras, computers, hard drives, vehicles and other property brought onto the premises remain entirely at the Customer's risk.
Cool Studio accepts no responsibility for loss, theft or damage to personal property.
16. Insurance
Cool Studio maintains insurance over its own premises and equipment.
Customers are responsible for arranging their own insurance covering:
-
personal equipment;
-
public liability (where appropriate);
-
production insurance;
-
loss or damage to personal property.
17. Liability
The Customer acknowledges that use of studio facilities and equipment involves inherent risks.
To the fullest extent permitted by law, the Customer assumes all risks associated with the hire and use of the Studio and Equipment.
Nothing in these Terms excludes any rights that cannot legally be excluded under Australian Consumer Law.
18. Indemnity
To the maximum extent permitted by law, the Customer releases and indemnifies Cool Studio, its owners, employees and contractors from any claims, losses, liabilities, damages, costs or expenses arising directly or indirectly from the Customer's use of the Studio or Equipment, except where caused by Cool Studio's negligence or where liability cannot legally be excluded.
19. Force Majeure
Cool Studio is not liable for delays, interruptions or inability to provide the Studio or Equipment due to circumstances beyond its reasonable control, including but not limited to:
-
power outages;
-
internet outages;
-
fire;
-
flood;
-
severe weather;
-
government restrictions;
-
industrial action;
-
equipment failure.
Where practical, Cool Studio will make reasonable efforts to reschedule affected bookings.
20. Photography & CCTV
Cool Studio may photograph the Studio following a booking for maintenance, insurance or damage assessment purposes.
Where CCTV is installed, it operates in common areas for security and safety.
Promotional photography of a Customer's production will only occur with the Customer's prior consent.
21. Privacy
Any personal information collected during the booking process is used solely for booking administration, security, legal compliance and communication relating to your hire.
Cool Studio will handle personal information in accordance with applicable Australian privacy laws.
22. Default & Termination
Cool Studio may immediately terminate a booking where the Customer:
-
breaches these Terms;
-
damages property;
-
behaves dangerously or unlawfully;
-
fails to follow reasonable directions;
-
fails to make required payments.
Termination under this clause does not affect Cool Studio's right to recover unpaid fees or damages.
23. Dispute Resolution
If a dispute arises, both parties agree to attempt to resolve the matter through good faith negotiation before commencing legal proceedings.
24. Governing Law
These Terms are governed by the laws of Victoria, Australia.
The parties submit to the non-exclusive jurisdiction of the courts of Victoria.
25. General
These Terms constitute the entire agreement between Cool Studio and the Customer.
No variation is effective unless agreed in writing.
If any provision is found to be invalid or unenforceable, the remaining provisions continue in full force.
Any rights or obligations that by their nature survive termination will continue after the hire has ended.
